1.Agreement

By creating an account or using the WorkScudo platform, you agree to these Terms of Service and to our Privacy Policy, AI Disclaimer and Cookie Policy.

If you use WorkScudo on behalf of an organisation, you confirm you have authority to bind that organisation, and references to "you" include it.

2.What the service is

WorkScudo is an employment record-keeping and reconciliation platform. It stores documents you provide, compares them against publicly published modern award provisions and superannuation guarantee rules, identifies apparent discrepancies and helps you organise and communicate about them.

WorkScudo is not a law firm, a legal practice, a financial adviser, a registered tax agent, a payroll provider or a government service. It does not provide legal, financial, taxation or migration advice.

WorkScudo does not connect to the Australian Taxation Office or to superannuation funds and cannot verify information held by them. All analysis is performed on the information you supply.

3.Accounts

You must provide accurate account information and keep your credentials secure. You are responsible for activity under your account.

You must be at least 15 years old and lawfully employed or engaged to create a worker account.

Employer and professional accounts require verification. We may suspend or decline an account where verification fails or where credentials lapse.

4.Your content and your responsibilities

You retain ownership of the documents and information you upload. You grant WorkScudo a limited licence to store, process and display that content solely to provide the service to you and to those you authorise.

You must have the right to upload what you upload. You must not upload content belonging to another person without authority, nor use the platform to harass, defame or unlawfully surveil anyone.

You are responsible for checking the accuracy of information the platform derives from your documents, including employer names, pay rates and classifications, and for correcting it where it is wrong. Outputs depend on the accuracy of inputs.

5.Accuracy and independent verification

WorkScudo applies award and superannuation rules as published and as interpreted by our systems. Award interpretation is complex and fact-dependent, and classification in particular often turns on matters a document does not record.

Figures produced by the platform, including estimated amounts owed, are indicative. They are a starting point for a conversation or a professional assessment, not a determination of legal entitlement.

You must independently verify material figures before relying on them, and you should obtain professional advice before taking legal action, making a disclosure to a regulator or remediating an identified shortfall.

6.Consent and disclosure

Worker records are private by default. Disclosure to an employer, legal professional, union or advocate occurs only on your instruction or affirmative in-app consent.

Consent is specific to a recipient and a purpose, is recorded in the audit log and may be withdrawn, although withdrawal does not undo a disclosure already made.

Professional users must maintain accurate conflict information and must confirm their own independent conflict check before accepting a matter. Misuse of matter information is grounds for immediate removal from the panel.

7.Fees

Core worker tools are provided free of charge. Employer and professional tiers are subscription based, with pricing and billing terms shown before you subscribe.

If optional paid services are introduced for workers, their cost will be disclosed clearly before you choose them. We will never convert a free worker feature into a charged one without notice and consent.

8.Acceptable use

You must not attempt to access data belonging to another user, probe or test the security of the platform without authorisation, reverse engineer the service, scrape it at scale, or use it to build a competing product.

You must not submit knowingly false information, fabricate documents, or use the platform to pursue a claim you know to be unfounded.

We may suspend or terminate access for breach of these terms, with notice where practicable.

9.Availability

WorkScudo is provided on an ongoing basis but is not guaranteed to be uninterrupted. We perform maintenance, and components may be unavailable from time to time.

During early access, features may change, be added or be withdrawn. We will give reasonable notice of material changes affecting your use.

10.Australian Consumer Law and liability

Nothing in these terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law or other law that cannot be excluded.

Where our liability can be limited, it is limited, at our option, to resupplying the service or paying the cost of having the service resupplied.

To the extent permitted by law, WorkScudo is not liable for indirect or consequential loss, loss of profits, or loss arising from your reliance on platform outputs without the independent verification described in clause 5.

For paid accounts, our aggregate liability in any 12-month period is limited to the fees paid by you in that period, except to the extent liability cannot lawfully be limited.

11.Termination

You may close your account at any time and export your content before doing so. We may terminate for breach, for legal reasons, or on reasonable notice if we discontinue the service.

Clauses relating to accuracy, liability, intellectual property and governing law survive termination.

12.Intellectual property

WorkScudo owns the platform, its software, design, branding and the reconciliation logic. You own your content. Nothing in these terms transfers ownership of either.

13.Governing law

These terms are governed by the laws of Queensland, Australia, and you submit to the non-exclusive jurisdiction of the courts of that state and the Commonwealth.
